1. Use of the Platform

1.1 Eligibility: You must be of appropriate legal age in your jurisdiction to access or use the TDC Grading Platform. By accessing or using the platform, you represent and warrant that you are of legal age in your jurisdiction.

1.2 Personal Use (Free Plan): The Free Personal Plan is intended for non-commercial use only. Users on the Free Plan may utilize the platform for personal enjoyment or education purposes.

1.3 Business and Pro Plans:

The Business and Pro Plans are designed for businesses and limited commercial use. Users on these plans may utilize the platform for commercial purposes, including grading products for business operations, marketing, and research. Users are permitted to state that data is graded using the TDC grading system. However, to uphold the integrity of the platform, it is not permitted to associate the grading as "TDC Certified" without express written authorization.

Commercial Use Limitation: 'Commercial use' of the platform refers to use in a business or organizational setting. However, using the grading data or any components generated by the platform for commercial purposes outside of the platform, including but not limited to resale, distribution, or incorporation into other products or services, is prohibited without obtaining an additional license or express written approval from Urbanistic.

1.4 Prohibited Activities: Regardless of the plan, users agree not to engage in any of the following prohibited activities:

• Using the platform for any unlawful purpose.
• Uploading, posting, or transmitting any content that is infringing, obscene, defamatory, or otherwise objectionable.
• Attempting to interfere with the security or integrity of the platform.
• Reverse engineering, decompiling, or disassembling any aspect of the platform.

INTELLECTUAL PROPERTY RIGHTS Unless otherwise indicated, the Site is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws and various other intellectual property rights and unfair competition laws of Canada, foreign jurisdictions, and international conventions. The Content and the Marks are provided on the Site “AS IS” for your information and personal use only. Except as expressly provided in these Terms of Use, no part of the Site and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.

We reserve all rights not expressly granted to you in and to the Site, the Content and the Marks.

PROHIBITED ACTIVITIES You may not access or use the Site for any purpose other than that for which we make the Site available. The Site may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us. As a user of the Site, you agree not to:

1. systematically retrieve data or other content from the Site to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.
